Nirvana: Grown up, the naked baby of “Nevermind” who had attacked the group for child pornography rejected by justice

Thirty years after the release of the album Nevermind for which he posed naked as a baby, Spencer Elden had filed a complaint last August for child pornography with a California court. The 30-year-old American has just been dismissed by the courts.

According to the music magazine Spin, a judge dismissed the case “with leave to vary”. Spencer Elden’s lawyers therefore have 10 days to file a new complaint. Nirvana representatives have until January 27 to respond.

The latter claim that Spencer Elden spent three decades playing on his notoriety as “baby Nirvana”, and add that the deadline for such lawsuits has been prescribed for 10 years. According to them, the claim that the photo shows child pornography is misleading.

But for lawyer Spencer Elden, the photograph taken when he was four months old and showing his genitalia makes the baby appear “a sex worker”. In question, on the cover of the second album of the group, the infant is heading for a banknote.

Yet imagined as a critique of capitalism, photography therefore takes on another dimension according to its lawyers. In the minutes, they claim that “the defendants intentionally marketed Spencer’s child pornography and took advantage of the shocking nature of his image to promote themselves and their music at his expense.”

In an interview with CNN, his lawyer Maggie Mabie had explained that the problem with this album cover is that “the central point of the image is the minor’s genitalia”, and therefore that “it is a very over-sexualized image that constitutes child pornography. “

But why did you file a complaint now? According to the lawyer, Spencer Elden was worried that this photo – and its genitals – would be circulating around the world again as the album’s thirtieth anniversary approached, released in September 1991. “If this image is censored, it will be a A monumental signal for all victims of child pornography, who will know that their voice is heard and that their privacy is respected, ”she added.

Spencer Elden claimed 150,000 dollars in compensation, or nearly 128,000 euros, from each of the accused. And they are many. Besides the still living members of the group – Dave Grohl and Krist Novoselic – Curt Cobain’s widow, Courtney Love, is implicated. The photographer who took the snapshot of the discord, Kirk Weddle, as well as artistic director Robert Fisher and several record companies that distributed the album were also targeted.

The thirty-something, who has nevertheless regularly resumed the pose, dressed this time, over the birthdays of the album – especially for the 10, 20 and 25 years of the release of this cult opus – has always maintained a special relationship with this photograph. of which he was the star in spite of himself.

At the time, his parents had only received compensation of 200 dollars, or 170 euros for the shot. They had not signed an authorization to broadcast the image, according to Spencer Elden’s lawyer.
