Promulgated on Saturday after its validation by the Constitutional Council, the law transforming the health pass into a vaccination pass comes into force today.
What is the difference between a health and vaccination pass?
Unlike the health pass, the vaccination pass does not recognize the negative screening test. It will therefore be necessary to be able to present a certificate of complete vaccination, booster dose included within the legal period, or proof of recovery from Covid-19, or a certificate of contraindication to vaccination, these last two documents being able to be issued. respectively by health insurance and doctors.
Who is concerned ?
From this Monday, the vaccination pass becomes compulsory for those over 16 years old. If the bill initially provided for the entry into force of the pass from the age of 12, this provision was finally excluded from the text.
Between the ages of 12 and 16, it is therefore the health pass which remains in force, with the possibility of having recourse to the screening test. Children under 12 are also always exempt from any pass or vaccination obligation.
Where will it be required?
The vaccination pass will be required in almost all places already subject to the health pass: bars, restaurants, cinemas, museums, performance halls, nightclubs, sports halls, certain large shopping centers, trade fairs, but also in interregional transport ( trains, planes, buses, etc.) Moreover, professionals working in these places are also concerned by the pass, and are therefore obliged to be vaccinated.
However, some places remain accessible with the health pass, such as hospitals, clinics, nursing homes or retirement homes. On decisions of the prefects, certain territories may also exceptionally remain under the health pass regime, “when local circumstances justify it”, specifies the site vie-publique.fr.
In case of doubt about the authenticity of a pass, the managers of the places which are subject to it, such as restaurants or cafeterias, may request an official identity document with photo from their client, to ensure that the pass matches the person in front of them. This provision was validated by the Constitutional Council, provided that these identity checks are carried out on the basis of “criteria excluding any discrimination”. The objective is clear: to fight against health pass fraud.
The penalties have also been toughened: people with a false pass or professionals who do not check the pass can receive a fixed fine of 1,000 euros for the first offense. Possession of a false health pass can also be punished by three years’ imprisonment and a fine of 45,000 euros.
What can I do to update my pass?
If you are fully vaccinated and you use the TousAntiCovid application, you do not have to take any steps to convert your health pass into a vaccination pass, since the QR Code remains the same. It is the professionals who will have to, from this Monday, update their control application (TousAntiCovid Vérif) to only take into account proof of vaccination.
Tolerance for non-vaccinated until February 15
The government wanted to introduce a kind of derogation for non-vaccinated people: if they receive their first dose of vaccine before February 15, they will be able to obtain a temporary vaccination pass, valid immediately after their injection in the places where the vaccination pass is compulsory, provided that you also present a negative PCR or antigen test. To then keep this temporary pass, they must receive their second dose within one month of the first.
