The night of Delphine Jubillar’s disappearance almost a year ago was to be at the center of the interrogation on Friday of her husband Cédric, suspected of his murder but who claims to be innocent.

He is heard by the judges for the second time since his incarceration in June.

The night nurse, 33 years old and mother of their two children, was last seen in their house in Cagnac-les-Mines, near Albi, on the night of December 15 to 16, 2020.

Friday’s hearing is “awaited for six months by Cédric, to explain the course of this evening and the night of December 16”, told journalists Me Emmanuelle Franck, lawyer for Cédric Jubillar, in front of the courthouse from Toulouse, a few minutes before the start of the interrogation.

He approaches it, she added, “impatiently, always with the will to explain things as precisely as possible to demonstrate, what he has said from the start, that he is innocent”.

Cédric Jubillar arrived at the courthouse in a prison administration van shortly before 9 a.m.

– “Desperate, combative” –

“We are happy that he has been heard. Since he has been imprisoned, this is the first time that he has been questioned on the facts”, underlined Me Alexandre Martin, another defense lawyer. According to him, his client “is not contradicted by any objective element of the file”.

Me Martin drew a contrasting portrait of Cédric Jubillar, placed since June 18 in solitary confinement at the Seysses remand center, near Toulouse.

“He is desperate, combative, always believing that justice will eventually open his eyes, said the lawyer. (The judges) will certainly try to push him to his limits, he will respond with sincerity and spontaneity.”

The first interrogation of the 34-year-old painter and plasterer, in his capacity as an indicted person, took place on October 15 and lasted four hours. He was also questioned in April by two magistrates, at the time as a civil party.

This type of questioning, before the examining magistrates, takes place in the presence of the defense and a clerk.

– Testimony of the son –

Last week, the eldest son of the Jubillar couple was heard by magistrates and reportedly recounted an argument between his parents on the evening of December 15, according to press leaks. A dispute already mentioned by the Toulouse prosecutor during the indictment.

“Those who broadcast what this child may have said, those who consider it useful for this child to be heard three times … I find that quite indecent,” lamented Me Martin.

“Children, in big criminal cases, that brings us back to terrible examples. If the prosecution is to want to hold the guilt of Cédric Jubillar on the word of a six-year-old child, heard a year later, c ‘is that really, they have nothing else, “he denounced.

Cédric Jubillar’s lawyers, who have filed several appeals to demand his release, believe that the “presumption of innocence is violated” and denounce an “abusive detention in a file without elements or evidence against him”.

For its part, the justice puts forward “a bundle of serious and consistent evidence” and considers that the evidence is sufficient to justify his continued detention.

In this investigation without body, confession, or irrefutable proof, many searches were undertaken by the gendarmes around the village and friends of the nurse regularly survey fields and woods, hoping to find a clue.

The two young children of the couple, who were in the process of divorce, were placed with the sister of Delphine Jubillar.
